In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – RODO), I hereby inform you that:

What personal data do we process?

The only personal data we process is the email address you use to send us a message. If we process other personal data about you, it is data that is linked to the email address you use, e.g., your first name, last name, phone number, job title.

For what purpose do we process your personal data?
  1. concluding or performing contracts or conducting other business relations, or for the purpose of preparing and responding to requests for quotations, determining the terms and conditions governing contractual relations, and participating in activities related to product development, with our customers, suppliers, service providers, and other stakeholders of which you are a representative or employee
  2. transferring your personal data within the Company for internal administrative purposes
  3. ensuring IT security and IT processes
  4. engagement of service providers, in particular internal and external IT service providers supporting our business activities
  5. conducting compliance proceedings

What is the legal basis for processing personal data?

The legal basis for the processing of personal data is provided by the provisions regulating the rules for the processing of personal data, including the processing of personal data via means of distance communication, and, as of May 25, 2018, the provisions of the RODO, i.e.:

  1. Article 6(1)(b) of the RODO: the need to take action before the conclusion of the contract by the Administrator at your request – in the case of the purpose specified above in point 2(1)
  2. Article 6(1)(c) of the RODO: compliance with a legal obligation to which the Controller is subject – in the case of the purpose specified above in point 2(2) and (5);
  3. Article 6(1)(f) of the RODO: the legitimate interests of the Administrator – in the case of the purpose specified above in points 2(3) and 2(4);

Who do we share your personal data with?

  • authorized employees of Aret LLC limited partnership, provided that this falls within the scope of their official duties
  • third parties that the company engages to provide specific services (e.g., IT services). In addition, we may engage, among others, legal advisors, management consultants, and auditors. Such third parties provide their services on our behalf and under our control and management, and may have access to personal data to the extent necessary to provide such services.
  • in addition, we may, to the extent permitted by law, transfer your personal data to domestic and foreign government agencies (e.g., pension funds, tax authorities, or law enforcement agencies) or courts in order to comply with the law or to protect the interests of the company.

How long do we process your personal data?

  1. Personal data processed for the purpose of concluding or performing a contract and fulfilling the Administrator’s legal obligation will be stored for the duration of the contract, and after its expiry for the period necessary to:
    1. after-sales customer service (e.g., handling complaints)
    2. securing or pursuing any claims to which the Administrator is entitled
    3. fulfilling the Administrator’s legal obligation (e.g., resulting from tax or accounting regulations)
  2. personal data processed for the purposes of marketing the Administrator’s own products or services on the basis of a legitimate legal interest will be processed until the data subject objects to such processing
  3. personal data processed on the basis of separate consent will be stored until such consent is revoked, whereby the Administrator will be entitled to process personal data despite the revocation of consent if processing for this purpose is justified on a legal basis other than consent

What are your rights and how can you exercise them?

  1. the right to access your personal data
  2. the right to rectify data if the data processed by the Administrator is incorrect or incomplete
  3. the right to request the Administrator to delete data
  4. the right to request the Administrator to restrict data processing
  5. the right to data portability, i.e., the right to receive personal data provided to the Controller and to send it to another controller
  6. the right to object to the processing of data based on the legitimate interest of the Administrator or to processing for direct marketing purposes
  7. the right to lodge a complaint with a Polish supervisory authority or a supervisory authority of another European Union member state, competent for the place of habitual residence or work of the data subject or for the place of the alleged infringement of the RODO
  8. the right to withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal)
